POPIA Rights
Your Data Subject Rights
Under the Protection of Personal Information Act 4 of 2013 (POPIA), you have the right to access, correct, delete, and object to the processing of your personal information. Mashiane Attorneys Inc. is committed to honouring these rights within 30 days as required by law.
1. Right of Access (section 23)
You have the right to request confirmation of whether Mashiane Attorneys Inc. holds personal information about you, and to access a copy of that information. We will provide you with a description of the information held, the purpose for which it is being processed, and the identity of any third parties who have or may have had access to it. Requests must be submitted in writing to our Information Officer. We will respond within 30 days as required by POPIA.
2. Right to Correction or Deletion (section 24)
You have the right to request that we correct or delete personal information about you that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or obtained unlawfully. Where we have shared that information with a third party, we will take reasonable steps to inform them of the correction or deletion. We may retain the information if we are required to do so by law or if it is necessary for a lawful purpose.
3. Right to Object to Processing (section 11(3))
You have the right to object at any time to the processing of your personal information on reasonable grounds relating to your particular situation, unless the processing is required by law. You may also object to the processing of your personal information for the purpose of direct marketing at any time, and at no cost. Once you have objected to processing for direct marketing, we will cease such processing immediately.
4. Right to Submit a Complaint (section 74)
If you believe your rights under POPIA have been violated, you may lodge a complaint with the Information Regulator of South Africa. The Information Regulator is the independent body established under POPIA to enforce data subject rights and investigate complaints. Before lodging a complaint with the Regulator, you are encouraged to first contact our Information Officer to attempt to resolve the matter directly.
How to Submit a Request
To exercise any of the rights described above, submit a written request to our Information Officer via the Contact Us page on this website. Please describe your request clearly, including your full name and contact details and the nature of the right you wish to exercise. We will acknowledge your request promptly and respond within 30 days. Where additional time is required, we will inform you of the delay and the reason for it.
